A state judge ruled late Monday night that Florida’s proposed property tax overhaul contains political slogans and misleads voters, sending it back to the state attorney general for a rewrite before it heads to the November ballot.
Circuit Court Judge David Frank’s decision is a blow to both the Republican-controlled Florida Legislature and Gov. Ron DeSantis, since some of the wording that drew fire from the judge was first proposed by the governor.
The most immediate question is whether the state seeks to keep the court battle going through appeals courts or opts to have Florida Attorney General James Uthmeier start working on a new version of Amendment 3.
“Today is a victory for every Florida voter,” former state Sen. Jeff Brandes, one of those who had challenged the amendment, said in a text message.
